SmartGear NZ Ltd respects your privacy and handles personal information in accordance with the New Zealand Privacy Act 2020.
Information we may collect
Depending on how you interact with us, we may collect information such as your name, contact details, billing and delivery details, order and payment-related information, communications with us, device or trade-in details, repair information, website usage information, and other information you choose to provide.
How we use information
We use personal information where reasonably necessary to process and deliver orders, provide pickup and customer support, manage warranties, repairs, returns and trade-ins, prevent fraud or misuse, maintain business and tax records, improve our services, and meet legal obligations.
Information collected from other sources
In some situations we may receive personal information from another person or service provider, for example a courier, payment provider, marketplace, repair provider or a person acting on your behalf. Where the Privacy Act requires notification of indirect collection, we will take reasonable steps to provide the required information, subject to the Act's exceptions.
Service providers and overseas processing
We use service providers to operate our ecommerce, payments, communications, analytics, courier and support systems. Some providers may process or store information outside New Zealand. We take reasonable steps to use providers and arrangements that are appropriate for the information involved and to comply with applicable cross-border disclosure requirements.
Security and retention
We take reasonable safeguards to protect personal information from loss, misuse and unauthorised access or disclosure. We keep personal information only for as long as reasonably required for the purposes for which it may lawfully be used, including applicable accounting, tax, warranty, dispute and legal requirements.
Access and correction
You may ask whether we hold personal information about you, request access to it, or ask us to correct information you believe is inaccurate, incomplete or misleading, subject to the Privacy Act.

Repair enquiry photos
We use repair photos for assessment, condition records and warranty support. For completed repairs, photos are retained for six months after the repaired device is returned. Photos related to an active repair, warranty claim or dispute are retained until that matter is resolved. Enquiry-only photos are retained for up to 90 days after the enquiry closes. We review and remove photos after the applicable period when no longer needed for these purposes or a legal obligation. We do not delete active-repair photos simply because 90 days have passed.
