SmartGear Warranty & Repairs
SmartGear NZ provides an express warranty on eligible products for the period stated on the individual product listing. This express warranty is separate from, and does not limit, any rights you may have under the Consumer Guarantees Act 1993 (CGA).
SmartGear Warranty
Our express warranty does not cover accidental, physical or liquid damage, misuse or abuse, unauthorised repairs or modifications, normal wear and tear, normal battery degradation, accessories/chargers, or software-related matters. These exclusions apply to SmartGear's express warranty only. Your rights under the Consumer Guarantees Act 1993 are not affected.
Batteries
Rechargeable batteries are consumable components and naturally lose capacity with age, charging cycles and use. Normal battery-capacity degradation is not treated as a defect under our express warranty. If a battery develops an abnormal or premature fault, please contact us so we can assess it. Any applicable CGA rights remain unaffected.
Chargers, Cables & Accessories
Chargers, charging cables, cases, screen protectors and other accessories are excluded from SmartGear's express warranty unless specifically stated otherwise on the product listing. Damage caused by misuse, bending, impact, liquid, incompatible equipment or normal wear is also excluded. This does not remove any statutory rights that may apply under the CGA.
Software, Operating Systems & Updates
Software availability, operating-system updates, security updates and the timing or method of their delivery can depend on the manufacturer, model, region and carrier software. SmartGear does not control future software releases or update schedules. Software-related matters are excluded from our express warranty unless specifically stated otherwise.
If a software issue means a product may not meet a statutory consumer guarantee, any rights under the CGA remain unaffected and we will assess the circumstances accordingly.
Imported & Parallel-Import Devices
Some devices sold by SmartGear are imported or parallel-import models. Where applicable, the product listing may identify the model number, import status, region or relevant software information. Imported devices can contain overseas carrier or regional software/branding. Carrier branding or software by itself does not mean a device is network locked.
Software-update availability and delivery methods for imported devices can differ from New Zealand-new models. If local-model status, a particular network feature or future software support is important to you, please check the product listing or contact us before purchase.
Physical Damage, Liquid Damage & Misuse
Our express warranty does not cover faults caused by impact, cracked or bent components, liquid ingress, excessive moisture or heat, incorrect operation, incompatible accessories, unauthorised repairs or modifications, jailbreaking/rooting, or other misuse.
Reporting a Fault & Assessment
If you report a fault, we may first ask you to complete troubleshooting steps and may then ask for the product to be returned so we can inspect and test it. This allows us to determine the nature and cause of the issue and the appropriate next step.
Please back up important data before returning a device and, when requested, remove passwords, activation locks and personal accounts so the device can be properly tested. SmartGear is not responsible for data loss during testing, software repair or restoration, except where required by law.
Warranty Period
The SmartGear express-warranty period begins from the purchase/invoice date and the applicable duration is stated on the individual product listing. Expiry of the SmartGear express warranty does not by itself determine whether statutory rights may exist under the CGA.
Consumer Guarantees Act
Nothing in this SmartGear warranty is intended to exclude, restrict or modify any rights or remedies available to consumers under the Consumer Guarantees Act 1993 where that Act applies.
